RETURN POLICY

Strictly Limited

Important Notice

RETURNS ARE NOT ACCEPTED AS A MATTER OF COURSE. ALL SALES ARE FINAL UNLESS EXPLICITLY AUTHORISED IN WRITING BY SAINT ARCHIVE MANAGEMENT PRIOR TO SHIPMENT OF ANY RETURN.

1. General No-Return Policy

Given the peer-to-peer, pre-owned and small scale business nature,  all items sold on the Platform, and consistent with applicable law governing C2C transactions, Saint Archive operates a strict no-return policy. By completing a purchase, the Buyer unconditionally acknowledges and accepts that:

​

  • All sales are final and binding upon payment confirmation;

  • No return, refund, or exchange shall be accepted or processed without prior written authorisation from Saint Archive Management;

  • The Buyer has independently assessed the listing, including all photographs, descriptions, and stated conditions, and accepts the item in the described condition;

  • Minor variations between photographs and the actual item (e.g., colour rendering, lighting) do not constitute grounds for a return;

  • Change of mind, subjective dissatisfaction, or fit/sizing issues do not constitute grounds for a return or refund under any circumstances.

2. Return Authorisation Process

Any request for a return must comply strictly with all of the following conditions:

​

  • The Buyer must submit a written return request to [EMAIL] within forty-eight (48) hours of confirmed delivery, providing full photographic evidence and a detailed written explanation;

  • The request will be reviewed solely at the discretion of Saint Archive Management, whose decision is final and not subject to appeal;

  • Saint Archive Management may approve, partially approve, or reject any return request without obligation to provide reasons;

  • No return shall be physically shipped until a written Return Authorizations Number (RAN) has been issued by Saint Archive Management;

  • Returns shipped without a valid RAN will be refused and returned to sender at the sender's expense, with no obligation on Saint Archive or the Seller to accept or compensate.

3. Conditions for Authorised Returns

In the rare event that a return is authorised by Management, the following conditions apply without exception:

  • The item must be returned in the exact condition in which it was received, unworn, unaltered, and with all original packaging, tags, and documentation;

  • All return shipping costs, customs duties, and import taxes are borne exclusively by the Buyer;

  • Saint Archive shall not be liable for items lost or damaged in transit during return;

  • Refunds, if approved, will be issued solely as platform credit (unless otherwise determined at Management's exclusive discretion);

  • Processing of any authorised refund may take up to thirty (30) business days.

4.  Non-Returnable Items

The following categories of items are non-returnable under any circumstances, including in cases of alleged misrepresentation, unless mandatory law provides otherwise:

  • Items described as sold "as-is" or with disclosed defects;

  • Items that have been altered, customised, or repaired after delivery;

  • Items whose original tags, labels, or authentication documents have been removed or tampered with;

  • Items returned after the 48-hour notification window has elapsed.

5. Statutory Rights — Limited Applicability

Users acknowledge that these Terms are structured for a C2C marketplace. The statutory right of withdrawal under EU Directive 2011/83/EU applies only to contracts between traders and consumers. Where a transaction is between two private individuals — as is the case on this Platform — statutory withdrawal rights do not apply. To the maximum extent permitted by applicable law, no further return or refund rights are extended beyond those expressly stated herein.

Nothing in this Section excludes liability for fraud, wilful misrepresentation, or any rights that cannot be waived under mandatory applicable law.

Seller Obligations
1. Accuracy and Authenticity

Sellers bear full, exclusive, and non-transferable responsibility for:

​

  • The accuracy, completeness, and truthfulness of all listing content, including descriptions, photographs, and condition grades;

  • Ensuring that all items listed are genuine, legally owned, and free from third-party claims;

  • Disclosing all known defects, flaws, or alterations without omission;

  • Compliance with all applicable laws regarding the sale of goods, including consumer protection and intellectual property law.

 

Saint Archive expressly disclaims all liability for inaccurate, false, or misleading listings. Any claim arising from a misrepresented listing shall be directed exclusively against the Seller.

2.  Prohibited Listings

Sellers are strictly prohibited from listing: counterfeit or replica goods; stolen or unlawfully obtained items; goods infringing intellectual property rights; goods prohibited under Italian, EU, or destination country law. Violation may result in immediate account termination, listing removal, and reporting to competent authorities, without any refund of fees paid.

 Payments

The Platform accepts payment via Stripe (credit/debit card), PayPal, and bank transfer ……... Payment is due in full at the time of purchase. Saint Archive reserves the right to cancel any order where payment is not received or is reversed, without liability.

In the event of a payment dispute or chargeback initiated by a Buyer without prior authorization from Saint Archive Management, Saint Archive reserves the right to permanently suspend the Buyer's account and pursue recovery of any disputed amounts, including associated fees and costs.

Shipping and Delivery

Shipping is arranged and managed exclusively by Saint Archive trough international and well reputable shipping company bears no responsibility for:

​

  • Delivery timelines, delays, or failures;

  • Loss, damage, or theft of items in transit;

  • Customs clearance, import duties, or taxes applicable in the destination country, which are solely the Buyer's responsibility;

  • Carrier errors or misdelivery.


The Platform operates worldwide. Buyers are solely responsible for determining the legality of importing any item into their jurisdiction and for all associated costs and compliance obligations.

Fees and Commissions

​Saint Archive may charge Sellers a commission if the product is on a consignment based . When the  Transactions will be completed and/or Buyers a service fee, as set out in the Fee Schedule published on the Platform. Fees are non-refundable in all circumstances, including where a Transaction is subsequently cancelled, disputed, or reversed, unless Saint Archive determines otherwise at its sole discretion. Saint Archive reserves the right to modify fees at any time with thirty (30) days' notice.

Disclaimer of Warranties

THE PLATFORM IS PROVIDED STRICTLY ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE.

Saint Archive expressly disclaims all warranties including but not limited to:

​

  • Warranties of merchantability, fitness for a particular purpose, or non-infringement;

  • Warranties regarding the accuracy, reliability, or completeness of any content on the Platform;

  • Warranties that the Platform will be uninterrupted, error-free, or free of viruses or harmful components;

  • Warranties regarding the authenticity, quality, or condition of any item listed on the Platform.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SAINT ARCHIVE'S TOTAL AGGREGATE LIABILITY TO ANY USER FOR ANY CLAIM ARISING OUT OF OR RELATED TO THE USE OF THE PLATFORM OR ANY TRANSACTION SHALL NOT EXCEED EUR 50 (FIFTY EUROS), REGARDLESS OF THE LEGAL BASIS OF THE CLAIM.

Saint Archive shall not be liable under any circumstances for:

​

  • Indirect, incidental, special, consequential, exemplary, or punitive damages;

  • Loss of profit, revenue, business, data, or goodwill;

  • Damages arising from reliance on user-generated content, including listings;

  • Damages resulting from unauthorised access to or alteration of User data;

  • Any amount exceeding the fees actually paid by the User to Saint Archive in the preceding three (3) months.


These limitations apply whether or not Saint Archive has been advised of the possibility of such damages and to the fullest extent not prohibited by mandatory law.

 Indemnification

Users agree to indemnify, defend, and hold harmless Saint Archive, its officers, directors, employees, agents, and licensors from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or related to: (a) the User's use of the Platform; (b) any listing created or Transaction conducted by the User; (c) any breach of these Terms; (d) any violation of applicable law or third-party rights by the User.

Intellectual Property

All Platform content — including design, code, trademarks, logos, and text — is the exclusive property of Saint Archive and protected by Italian and international intellectual property law. Unauthorised reproduction or use is strictly prohibited and may result in legal action.

By uploading content to the Platform, Users grant Saint Archive an irrevocable, perpetual, worldwide, royalty-free, sublicensable licence to use, reproduce, modify, and distribute such content for any platform-related purpose, without further consent or compensation.

Modifications, Suspension, and Termination of Platform

Saint Archive reserves the absolute right to modify, suspend, or permanently discontinue the Platform or any part thereof at any time and without notice or liability. Saint Archive may also modify these Terms at any time. Continued use of the Platform following notification of changes constitutes unconditional acceptance of the revised Terms.

​Dispute Resolution and Governing Law

These Terms are exclusively governed by Italian law. Any dispute arising out of or relating to these Terms or the Platform shall be subject to the exclusive jurisdiction of the courts of [CITY], Italy. Users expressly waive any right to bring claims in any other jurisdiction.

Prior to initiating legal proceedings, Users must submit a written complaint to [EMAIL] and allow Saint Archive thirty (30) days to respond. Failure to comply with this pre-action requirement shall render any subsequent claim inadmissible.

EU residents may access the European Commission's ODR platform at https://ec.europa.eu/consumers/odr, though Saint Archive's participation in ODR procedures is voluntary and at Management's discretion.

​Severability and Entire Agreement

​If any provision of these Terms is found to be invalid or unenforceable, such provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force. These Terms, together with the Privacy Policy and any applicable Fee Schedule, constitute the entire agreement between the parties and supersede all prior understandings.
